It was great meeting and working with everyone especiallyJay,Aman,Himanshu,Vandana,Prateek,Nilli, Vandana,Mark,Tamsen,Puneet (yes- I am being nice to you inspite of the lawyer jokes u crack at my expense!!!),Anil,Sanjeev,Rajesh,Macacaa(yes I was a bit too hard on you:)but it was all in good spirit) and ofcourse my friend Meenal. I just want to thank a few volunteers who worked on lobby day meetings with me but could not attend the lobby day or the rally day-Fora,Vasu and Payal. We are all so glad the lobby day meetings and the Rally went well. It really shows what we can do when we all get together. Kudos to IV and its members!

I think TSC might wait until August 1st. Because if they send before August 1st they might end up giving 2 year EAD. So it might be trick. But i don't care whether they issue 1 year or 2 year EAD. As long as they issue EAD before it expires i am okay. Let's see tomorrow.

I have read that the Chicago cases were going to be moved to from May. BUt what about the cases that have been in Audit since Jan/Feb 2008. Were they also moved or something.

All of the Chicago cases have been transferred to Atlanta. If the Chicago guys want to talk to me, I�m happy to do so. They don�t have to hire me if all they want is information. As for putting names and case numbers, without that information, they won�t take the letter seriously. Also, I think that this will get the DOL to move on those cases. Almost every time I have made a specific complaint, they have responded by resolving the case right away in order to make the whole thing go away. It wouldn�t surprise me to see the same thing here.[/QUOTE]

2. How long as it been since the last advertisement
3. Can they file another I-140 concurrently with I-485 using the recently approved labor
4. I agree with abhijitp you can get a RFE too
My suggestion would be to apply in EB3 even though the job advertisement reads masters or Bachelors with 2 years and use the option 3
I request you guys to consult a good attorney immediately and help your selves and also save time.

i have no idea what ur talking about. i just looked at all the bulletins on the dos website and there was no question of retrogression till january 2005 when india and china
retrogressed to jan 2002 for EB3...it moved forward till june2005 (retrogressed to june2002) before it became unavailable.
Finally retrogression as we know it hit on october 2005 where eb2 moved to 99 and eb3 to 98
so where does "brief retrogression" in 2003 happen?

The PDs in the visa bulletin are valid until the next visa bulletin is released or until the end of that month?
I think they are valid from 1 day of a month to the last day of the month but I hear people say that they are valid only until the next month's bulletin is released.
Any inputs here?

AILA is trying to establish a precedent by saying that only the VB is the one that should determine the visa availabulity.
This means that restting VB dates is legal.
I can not believe AILA and immigration lawyers are so incompetent. What are they fighting? Just amazing! No end to Immigration crap!

There isn't much to be calculated for EB3. With spillover practically non-existent for EB3, we can easily calculate our wait times from pending inventory data published by USCIS.
The only positive development is that 245(i) cases that has been eating into EB3 quota is done with. So dates are no longer stuck at april 2001. We should see a slow but steady movement. Unless some spillover happens once EB2 has become current/close to current, I don't see much hope without legislation.
For those folks who think of not participating, consider these facts. Aman Kapoor and other IV core folks who already got their GCs are still working for our cause. There are lot of EB2 members among IV volunteers who work for this cause. We shouldn't just think of this as our personal issue. Rather we should consider this an issue for the entire EB community and work to resolve it.
