    To he who handed over $7K.....

    If you have good documentation of this... then there are some fees that employers are not allowed to pass on to employee (either in part or in whole).

    These include things like H1B processing fees.
    They might include labor certification fees (required for GC).

    Now unless the 50% specifically identifies which fees, I would take it to mean 50% of all. If your were charged for 50% of something that it is illegal to charge for then Department of Labor may pursue both on your behalf and in the public interest. By pursue, I mean get your money back (or some of it) and fine or worse to employer.

    So find out what documents you have and where your local dept of labor is, and go and pay the friendly staff a visit.

    I know someone that was done out of a few thousand in unpaid overtime. They got his money back for him, even though he only went to them years after, but he had pay slips showing hours worked and money paid. They handled it all for him.

    Thank you so much and really appreciate for giving me an idea on how to approach.. I will look into my folders and see what all proof I have in order to defend myself...I know the fact that all my emails communications and shared documents, payslips are still in place and will for sure find something out of it...

    I am not trying to question your intent just trying to get some knowledge of facts. However your reasoning suggests that there are numbers available to overflow from EB2 World to EB2 India. What if there are just enough numbers to keep EB2 World rolling. I will be interesting in learning more about how these allocations work. Thanks in advance for any information you can provide.

    If you are really interested in learning more how these allocations work, You might want to talk to 2 depts in Bureau of Consular Affairs.

    Will I-485 package get rejected if no employment letter attached?

    While rushing to send our packages to USCIS on July2nd, we could not get our future employment letter signed and did not include in the package. But now I have the employment letter.
    Experts, do you think I need re-file or wait out?
    Anyone is in the same boat got their receipt#s or still waiting

    Forget Polls. Polls are no way going to help any one. If people are complacent that they have filed for 485 and can enjoy the ride they are mistaken. If people are worried that their receipts havent been generated in 60 days, they are unnecessarily worried.

    If all the people in the DC area who are affected by this participate along with their families, we have more than 10,000 number. As paskal said, my job my vacation, my manager, my time off, my, my ... my. I am talking with people and I explain them. I get a weird response. What can I do? I filed for my 485. I will get my EAD & AP.

    I ask those guys what will you do if the economy tanks in Dec/Jan time frame and you lose your job? All the hard work you have done in your job for the past 6-8 years, your manager and nothing comes to rescue on that day.

    Its our choice. Its in our hands. Its in our minds to make a decision to actively participate in the rally.

    Call your friends in DC and wake them up. Let them cuss at you. Dont give up. Dont give up

    Attorneys will obviously give this kind of answer because their loyalty is to their client which is the employer who gives them their revenue. So they'll answer which would be in favor of their client.     I have several friends who were waiting for GC desparately and they thought it was the final destination. They had many reasons why to get GC and once they get, they will be free and can do / will do everything possible. But, once they got it, they settled in a permanent job. Without GC, they were working for the same client with even more pay and life was good if not better.

    I was thinking the same way; because I am no different.

    Oflate, I realised, I am un-necessarily worried about something which is not in my control. I realised that I am well paid, with this pay even the benefits I am not getting are compensated. Why am I worried? Should I be after GC in order to get peace of mind? I started looking it little differently. I am in this country to earn more money and live comfortably. I am already enjoying what I wanted. Then, why am I worried still? May be it is in human nature to always look for something which is not in the hands.

    I still need GC for other things like Children education and get some other benefits (our education / starting business etc). I agree, but there is lot of time for that in my case. There are several people who are in the same state as me if not all. Everyone's needs are different.

    I thought I will just share my ideas so that atleast some of the people will be happier.

    1997 - H1B
    2000 - LC filing
    2001 - LC cancelled by company because of 911. If company responded to RFE, Labor could have been certified.
    2006 - Laid off while on 9th yr of H1
    2007 - Back on H1 transfer

    Spouse
    1998 - H1B
    2001 - Filed LC because my company cancelled LC
    2003(Mar) - PD
    2005(Sep) - LC approved
    2005(Dec) - I-140 approved
    2007(Apr) - Can file AOS/EAD now

    The secret.....

    PRAY, PRAY, PRAY. Nothing beats it.

    To those who don't know, it took Noah 120 yrs. of faith and hope to built his arc when he was asked to, by Our Heavenly Father.

    If you really looking for long term solution then you should focus on action items that core members asking us to do...Have you done any of these?

    members will file 485 whenever they can and whenever they want to. I don't think even single person should buy this idea.

    it is not clear to me that this version allows legal kids to benefit
    it talk about people being "otherwise deportable"
    someone needs to clarify with an immigration attorney or something
    I emailed my attorney to see if she could clarify whether legals are able to benefit from this bill...I'll post an update once she replies. Have a good weekend!!!

    very well said goel.. I said the same thing to IV and I got God knows how many reds. The only time I saw a huge impact was after July fiasco but again it was not IV's alone effort, many other organizations were included.

    Honestly IV is a great platform to help members with their questions and exchange knowledge about immigration topics but nothing more.. I don't expect the founders to leave their full time jobs to address immigration issues as without a job they won't have any immigration issues.

    To people who say that illegals have huge support and resources that is because they have lobby money from businesses who need cheap labor, lawyers who need new clients and politicians who need (future) votes..

    In our case business know that first we are not any cheap and second they can move the jobs overseas.. Lawyers already know that they have us by the b***s and politicians flip - flop depending on who they talk to (citizens or us).

    I think I have joined IV in last 3 years or so...
    Donated money once & have called congressmen & senators many times ...

    Could someone please tell me -

    What has been achieved by IV till date? I know we all meet elected reps, officials in washington dc ..... but I am interested in end result like not wasting visa numbers , implementing spillover & along these lines.

    I have asked few friends to join IV but then if they ask me for IV accomplishments - i can't count any....

    Even if PD is not current, I believe you can convert CP to AOS. Check Murthy website or talk to them.

    If this cannot happen for you then you should look for a change towards this provision.

    But EAD & AP fro CP is not going to fly administratively. As others have stated it is contradictory.

    Firstly, I'm a supporter of CIR...but I still sense some ambiguity in these lines...

    may be it's just me...:)

    The specific details is what we are all waiting for. CIR seems to be the only way to expect some change for EB. We need to work for this change to be a good one for us.

    I hope it doesn't retrogress in future.

    I still don't understand why is EB-2 not moving forward especially that EB-1 is current.

    Too many people converted to perm-EB2 when EB3 retrogression hit. Also, excess EB2 RoW are not flowing to EB2-India but to EB3 instead.
