In general a person who is in the US should have a valid and unexpired passport at all times. In addition, there is a whole loooooong list of documents that you attach to the I485- your attorney should advise you on this. The most important once for employment based immigration are documents showing legal status up until the I485 application and current offer letter from your company. There are many many more documents you need to provide...search the net for the necessary documents...

Macaca, what a great idea! Can you or someone approximate the figure f how much we have cntributed to SS (and better yet, how much would stop going into SS if we all left in a reverse brain drain)

SS is a mess and so everyone loves the donations (not contributions).

striking the iron when its hot.
But lets give the IV core and volunteers a few nights of good
sleep. They have all been working really hard and deserve this.
I am sure they have a strategic roadmap for us..
You know that's my point. do you really think we can't do nothing more?.....
we are highly sklilled smart and great immigrants creating the new America of the 21st century we can't just say, thats it lets wait.....
This country is about money, and we have the tremendous advantage that elections are coming, lets see the big picture.. why dont we jump to the next level from street protesters to work with one of the candidates or 2 or 3 , if they see money they will push our cause. Lets work on that now...
So those guys who attended the hearings or met with senators. what was the result? what did they accomplished? did they get the opportunity to participate with the senator or law maker in an action plan? or we just wasted that opportunity asking for autographs? please those guys post your comments.

i read on some lawyers website that everytime he/she's filed an AC21 letter to show change of jobs he's gotten an RFE for the petitioner.
so that is why many lawyers recommend against sending any notification to USCIS regarding job change using AC21.
Going back to the supplemental AC21 memo:
Imagine an IO who has a very bad mood for the day. Then he receives an AC21 letter for the case he is processing and saw that the i-140 of the person is not yet approved.

For all Eb3s along with EB2s with PD after April 2005, the movement in the coming visa bulletins wont be much encoraging unless the new Obama government does something significant about employent based category or immigrationvoice does a fruitful lobbying. The doings of something by obama government to employment based category is not in our hands. The only thing we could do is to help IV and help ourrselves by contributing to it to reach its financial target for better lobbying. Or else wait for the Visa Bulletin every month with great hopes, sorry dreams, for your PD to become current, and satisfy with your EADs for years ahead

Though the website says sold out, I called just now and got a queen room for 109+tax for one night 17th. Thanks for the help.
I just called and the guy said he has the room ; he then started taking all my information and finally asked when I would arrive. I told him on 17th, 7:30am and he said " oh sorry we don't have any room, I thought you wanted it tomorrow"
So check it up again.
Also, if your room has 2 beds, can you share the room with me? We can split the bills and I needed a company too. I am trying to book a room but so far no luck. I still need to book a flight too. I am flying from Oakland on 16th night. Thanks

MS from some vague sidey backstreet community college cannot be compared to MS from other better off schools.

In the same lines as H1B, could we look into if its possible to add a quota for US Masters degree holders irrespective of country of birth for green Card also. This would be in addition to the existing Employment based quotas.
Does anyone know how they added 20k H1B quota for Masters degree holders? Who sponsored that bill? May be we should talk to the same people.
I would think there would be a little less resistance for this? This would ease the pressure on both EB2 and EB3.

Because of sudden influx of projects coming to India last year, there was a temporary upsurge in the demand for skilled personnel in india ....So there are many options for these people which caused the higher attrition as they have many options open....So temporarily these IT Companies used to retain highly skilled employees at any cost and kept them in front line and recruited some freshers (i have seen one company recruited freshers and charged them 50,000 ...you heard it right :0 initally with the commitment of 2 years).
As the freshers are catching up with the experienced ..i see a sharp decline in demand my area of expertise from past 6 months to an Year .... But from CEO point of view , still work is done ..with 40 % or more saving ..may be for little compromise on quality ....
I have a feeling that attrition rate may slow down in coming years .....
Any one please share your views /experiences ..

Duplicate application will definitely create problems I will told today by the USCIS rep. They don't recommend it at all and neither my lawyer. He has refused to re-file or will only re-file if I take the onus/responsibility of the result.
USCIS rep also informed me that as long as you have a tracking proof that you application was delivered, you should be able to refile after Aug17 also, in case application was not processed because it was lost or so.
USCIS feeds us lot of BS. Their reps have no idea about the whole immigration process. You get different answers each time you call. Atleast 3 different reps told me that it's fine to refile except that I will lose the money and one rep told me that I can always request USCIS to refund my money. Go figure.

Did you guys get a chance to look at data for Mexico by any chance? Since there is only a backlog for EB3 can one assume that things will improve in the next 2 years or will legislative relief be required for Mexico as well?

I think this has a better chance than rest of other EB bills, because US wants more skilled persons and by defintion advanced degree holders from US in STEM are. Congress extended 20,000 H1 visa for US masters and PhD graduates some years ago whereas they were and are loathe to extend the total H1 numbers.
Going by this logic, I think this bill will go farther and gain traction. Lets's keep our fingers crossed.:)
In one stroke, this bill helps both a) US advanced degree graduates and b)non US graduates (i.e, EB applicants), as 1) it puts EB1 and EB2 in non quota category (I,C,P,M and ROW) and 2) frees up EB1 and EB2 numbers for EB3.
