Friends,
I am worried if I would have any problems converting to H1 since I am practically out of work force since 2000.
I have 3 yrs worth of exp prior to moving to the US on H4 visa in 2000.
Do you think I would have any issues with getting H1?

Having said all this, I think it is safe to stay for a few months and then move on.. Wehave waited for nearly a decade.. what's the problem in staying for 4 months or so.. just take a vacation and go to India.. A month will go while in India, couple of months in planning and another month in recovering from Jet lag.. there you go.. it is 4 months now..
My cousin took a offer from a employer in CA who who did her H1 transfer but the condition mentioned in the agreement is that
In the event the employee voluntarily resigns or her employment is terminated for performance or cause prior to 3 years, employee agrees to reimburse the "Employer" for the full amount of legal, administrative and filing fees associated with the sponsorship of the employee's work visas as permitted by law.
The employer won't do premium processing so my cousin paid $1000 on her own but she had to travel outside the country to canada to get a new I-94. The employer's law firm filed the paper work with canada embassy in US to get a canadian visa.
Now my cousin got her GC through her hubby which her employer does not know .
The employment laws in CA are different in the sense that all these agreements are not valid so how can she move (if moves within 3 yrs) to another company without paying anything or a little fee to the employer. I told her that H1-B fees are not too high maybe around $4000.00 so the employer will have to spend lot of money on the lawyer's to go to court to suit her if she left say after 2 years of employment as she feels that the agreement is one sided considering the time line.

I didn’t want to go to DC rally due to my surgery appointment (September 6th) because I can not fly for three weeks after the surgery.
Guess what?, I have postponed my surgery appointment date, booked tickets and going to DC rally on Monday evening and flying back on Tuesday night.
I also urge people to take a day off and attend the rally.

No. I am not an employee of any of the companies named in H1B visa fraud last week. The current employer is my the sponserer of my H1 B visa and also my first employer . I did not change my employer.

What is received date? What is delivered date? How come there are 6 days gap between those days? Even if you assume that the receiving guy took 6 days to lift his hand and receive, how come the received date is before the delivery date? So he received it even before it was delivered to him.

The best thing to ask for is a "time factor". If you have been in the US LEGALLY for a certain number of years (say 5 years), then you can apply for a Green Card (GC). That way people who have put some roots here over time will be able to become permanent residents. It also provides an incentive to immigrants to stay in status.
Why should there be a time factor from "GC" to "Citizenship" and none from visas like H1 to "GC"? It doesnt make sense! After all, I would think it should be harder to become a Citizen than to becoming a GC holder.
US should look up north to their Canadian neighbours for a good immigration system. A point system too would not be bad. It can determine how deep you have put down roots and then give you GC based on that.
Take for example, someone educated in the US, has been working on H1B for 4 years and with three kids that are American Citizens, and posses two properties in the US. It doesnt make any sense for that person not be able to becomoe a PR. Infact if he loses his job today, he's shown the door... that same day.

i dont know if the above is true only for consultancies?
i work in a big software corp and never heard of any queries at all?
approved 140, file 485, wait for 180 days, change jobs, no queries at all (irrespective of whether you change jobs or not)
am i missing something here?

If 485 application is pending for longer time, say more than 2 years, I have seen that USCIS wants a reconfirmation from the employer that they continue to support the green card application for the position for which the application was originally applied. This is not just applicable to consulting companies alone. Any types of companies and applicants in any categories (Eb-1,2&3) could get RFE at the last stage of the process. So to have your application processed without a shred of a doubt, it is best to be in a position to reply that RFE anytime during the process.
