Most of my colleagues on L1/H1 visas went back upon completion of their 5/6 year terms, they never applied for GC. Couple of them are right now packing back.
The management of the company (not IT related) bravely decided to replace the "aliens" by american engineers. This proud decision had a disaterous consequence - our international based customers pulled back and found other contractors. Despite of all the money pumped to promote the "american" presence in the company, down-sizing is on its way and closure is on the horizon...
I was stupid enough to decide in 2003 to apply for a GC and to bear all this BS. Now working hard on plan B and waiting for the right moment.

Hi
My wife have H1B approved in 2005.Her stamping was refused on 226(g) section.She came to u.s.a on H4.Now her employer has applied for premium H4 to H1 transfer for her.
We didnot hear anything from them.It is already 2 weeks.
If it goes through.Does she need to go back for stamping to start working.
How the things will be?
How long the process will take (transfer)
If the attorney can help me in this,it is really great and appreicable

You can send 2 x 2 photo.. they will cut and make it like a 3.5cm x 3.5cm Or you can use epassportphoto dot com to get yourself a 3.5cm x 3.5cm passport photos for less.

My wife will be on h1b from oct 1 (currently on h4)...we have a planned visit to India in mid october and that when we plan on getting her h1b stamped (around october 20th or so). My question is since we will be travelling when her h1b has already started yet we wont have any pay stubs when we go to the consulate for stamping...will this create any problem? Also what other docs do we carry with us for the same...

I tried to run twice last week but had to walk 2 out of the four miles because of the 100 degree temperatures in So.Cal. it is so much easier to stick to the classes I take in an air conditioned GYM but a new activity helps. I am proud to be part of Team IV and raising funds for the cause I believe in

It is pretty obvious they will surely receive more than 40K petitions. Who knows, they must have already got the same in June when they advanced the dates in June VB. Visa numbers are allocated at the time of approval and not at the time the petition is made. Even if they get million petition in July, that does not mean all the Visa numbers are consumed. It is an indicator they have enough petitons to meet the demand to use all the available numbers and alter the VB Cutoff dates for PD in future months. It depends on the approvals too and it is not likely the petitions made in June/july will get approved now... So we must be okay.. but you never know with USCIS/DOL/DOS... Any thing can happen... for instance like the VB is Current for all categories in July.
That's what we all are thinking, that we should be okay. But when rumors like these are posted on reputed attorney's website, it will surely create panic among people.

the flyer is a word file and print several copies and keep it in your car. When you go for shopping, groceries, temples, etc... keep them in your hand and if you see someone like you .. (South Asian, Asian...) there is a chance they maybe retrogressed.
Give them the flyer.
Sometimes you will be pleasantly surprised to meet other fellow IV member and will make new friends.

If we are claiming to be best and the brightest having high skills and inventing then it is EB1 and EB2 mostly. By law EB3 is mostly for people who have Bachelor degree and hardly any experience in their field to claim as EB2. It does not matter you are masters from Harvard but by law, if your job requires just a bachelor degree then you are doing basic work at lower management. Legally EB3 have no case if they claim to be best and the brightest inventors. All doctors get EB2 or EB1. All managers with advanced degrees get EB2. All Scientists and PhD holders get EB1 and EB2. So EB3 is mostly people who are low skilled programmers, people in professions doing lower line work or people who despite having higher degrees are doing jobs that do not need advanced skills to be the brightest folks immigrating in USA. There are some exceptions of people who are screwed by their lawyers and employers by forcing them in EB3. These people should fight with their lawyers and employers or change their jobs to EB2. EB3 do not have a strong legal case to fight for EB3 if they claim to be best and the brightest. It is very humiliating but you like it or not EB3 is grouped with EB3 Other Workers that are waiters, janitors, construction workers, Farm workers etc.
So if we PORT for EB2 then we also become best and brightest?
BTW brightest are only EB1s (since you have EB2s doesn't mean EB2s are brightest)

The packet was just asking me to confirm my address, and my soliciters address and details. They sent a copy to me, my soliciter, and my employer.
was mailed to me on the 18th of april.
on the cover letter, it said i had been sent these because my PD was about to become current, and or a visa number would be available for me within the next 3- 6 months.
My take on the Mumbi consulate, VB, is just wait and see. It says most other countries, not ROW...and to be honest, i am not guna belive anything untill i see it on the state dept web site. in the full VB which should be out next week.
Im consular processing, im not even on the USA yet, i have had my job held open for the last 2 years.
i carnt see row moving forward that much but i think it will move a little. i dont think it will move back.

There are 300k Applicants(conservative number) stuck at various stages for immigration relief. All of us want a reasonably fair and a little faster adjudication but none of us want to contribute, raise our voice or be heard.
We are legal-tax paying, high earning, skilled immigrants (would be- permanent residents and future citizens.) who contribute trememdously to this economy, and we are employed by employers who did not find suitable citizens in their cities/counties. NOW!. If we do not organise and get heard! we are the ones to suffer. "squeaqy wheel gets the grease".
Shame on us, If we cannot talk to other people just like us who are stuck, how can we make ourselves heard to the majority at large. IF we are not bold enough to invite our friends to join IV, then maybe we ought to get stuck in this mess.
It is time to act, organise ourselves. Time to invite our friends to join IV and make them aware and encourage them to participate in the activities like writing to editors, raising awareness, joining state chapters and fund raising.
Lets add atleast one more friend.

With parameshwara's anugrah, my status changed yesterday(Sep 1st, 2009) to "Card Production Ordered".
End to my long wait and frustration.
I wish and hope others get their card soon.
Thanks to ImmigrationVoice team for their work without them, USCIS wouldn't be so efficient and wouldn't have cared to process the applications in the order of PD. IV is doing lot of things which will help the immigration community and I completely support their activities.

Once USCIS completes data entry of all 800K 485s (may be with in next month) they will have clear picture. They may give a report to DOS, how many waiting in each catagory (EB1,2,3) with PD with countrywise break out. Then DOS will easily setup the cutoff dates. This may happen in Jan or Feb.
I feel that EB3 India may stay like this (in 2001). EB2 India may go back to 2003 or 2002 , based on how many guys in EB3 with PD 2002, 2003 converts to EB2. All other countries may see slight forward movement.

I definately finish all the events I participate in. This is the first time I am going to be raising funds for a cause I support and this is the first time I registered as a member of a Team for the entire year. I have supported some friends raise funds for the causes they support but never did one myself.
I have never run before............not even a mile. I still cannot and have just started training for the DC 10 miler. So please do not feel shy about running even if this is your first time. I agree, this is the way politics works most of the time. lobby for votes, etc.
But isn't it also their job to do what is in the best interest of the Nation. Everything isn't decided by lobbies.
Maybe we're approaching this the wrong way, in trying to build competing lobby. it needs a new approach. Congress should be convinced in a different way.
Lobby is for optional, nice to have things, which will not be generally missed if they fail.
Legal immigration is none of these and is almost mandatory. Imagine losing for eg. 200K EB3s. another 50K doctors.

if it began on the first day of that "pending period" then you are good...
The approval has from Feb16th to so and so time. It does not talk anything about the time between spet/04 to feb16/05. So this is called pending status, that's why there is confusion regarding this matter.
Anybody was in similar situation? or recaptured this time to file H1?

There is no proof that the new bill will reduce costs at all! It will take many years to realize it anyway. Reform was needed but not at this moment when there were bigger issues that needed fixing in 6-12 months.
In the long run it will. The issue was that people could not afford to pay their healthcare insurance premiums. Those of us who are lucky to have high paying jobs and good employers can very look down on the folks that don't have healthcare. However, health care is now a human right declared by United Nations in Dec 1948. In the US, the largest developed nation, there are millions who cannot get healthcare (only emergency care). Even if this healthcare doesn't reduce it drastically in the short term, it will stem the rising costs eventually. That is the long term projection at least. Think about how much cheaper prescription drugs are in Canada when compared to the US.
I think that "what we are debating here is "what is better for the US". You and I can contribute to the SS and Medicare system that we are not allowed to draw from until we have greencards or become naturalized citizens. The illegals you mention are in the same boat. The point that I am making is that the anti-immigration lobby sees all immigrants in a single light. If we try to divide ourselves away from the low-skilled we are not going to get anywhere. Immigration in general touches a number issues - civil and human rights, economics, etc.. By trying to distance ourselves from any of these issues, we are in fact make it more difficult for ourselves. For the record, I do want a green card, I want a fair system. I don't believe in treating one person different from another because of their background or the kind of work they perform. (that's just to give some perspective regarding my views on the issue).
