In my earlier post, I dint mean to say that all Kinkos are bad, its just the particular one near me was not good enough. The photos were as if they were taken with a yellow filter on their lenses.
Sears did a very good job instead.
You can just tell them that you need photos for passport. They are the same requirements
Think it this way, your photo might be scanned by their machine to be printed on visa/notice. If the photo is not of good quality it might get pixelated after they scan.
So be your own judge, think if you were in USCIS shoes and had to scan a photo and produce it on visa/stamp. They might also use some image recognition softwares for which they require exact speicifications.
In my case the yellow tinge I got from kinkos exactly matches with the improper color on the website below. So i had to go for other option

As per the memo if the I-140 petition was approvable at the time of filing, one should be fine even if employer tries to withdraw unapproved I-140.
If there is an RFE, then sure things are messy if employer does not cooperate.
If you try to use AC21 without an approved I-140 your employer can withdraw the I-140 petition ( since it is not approved yet ) . So best wait a few months until it is approved and then merrily go the AC21 way

all it matters is what individual members will vote if we have time we should go and meet our lawmakers who ever runs for president in 2012 will have this in his/her campaign.. but who ever becomes the president its the congress which does the voting and decides the fate of the bills.. only if we have more ppl meeting with each of lawmakers on regular basis we have some future either with CIR or w/o CIR via piecemeal

Nice story :) I had a clause in my first contract that I had to work for a company at least for 6 months or I will have to reimburse all H1B-related expenses. Well, I left the company and when the company's president called me, just told him to get lost. Never heard from him again. Looking back, I should've sued the company because it did not pay me full salary for the first month while I was on the "bench" (searching for a contract). Well, I am just too lazy :)

They change this number later in the year, since some of the FB visa allocated are retruned back to the pool (if the person getting GC does not enter the country in specified time).
They allocated a huge chunk of EB2 Visa to South Korea 7125 (currnet all through the year). Same with EB3 SK got 4727 (close to sum of India and China).
So i agree things will move slower this year but still move forward. We will not see an EB2/3 India/China Current any time soon unless they screw-up again like july 07.

Was this is a change in the procedures of USCIS? If yes, could we not request them to increase the length of the EAD from 1 to 5 years? This will help many of us too. I need to get my DL renewed every year along with the EAD.
Well there was court case related what constitues the 6 years where court said that only period of stay on H1b in US (so period of stay outside US on H1b) doesnt count.
So the law didnt change its the interpreation of law that was changed by the court case.
Same logic goes with H4 (they dont work on H1B ) so it was a matter of time someone would also challenge that on court and win.

Note that after marriage, the GC for spouse needs to be filed under FB category which has a backlog of 4-5 years
F1, b1 and b2 visas are not dual intent (requires non-immigrant intent). On all forms you need to mention the visa status of all relatives who are in the US. So watch for that.
H1, L1 are dual intent visas. Pending I130 does not affect L1 or H1 visa approval since these visas are dual intent. This is usually the safest option.
Follow to join (Consular processing) helps if you were married before the 485 approval.

This is what I got from 4 separate lawyers when I was invoking AC-21. I think everybody should speak to a lawyer before invoking AC-21.
A lot of people out there think that after getting EAD one can invoke AC-21 to change to any job at any employer. This is not true. AC-21 is pretty complicated and I think that in the future, if there is no change in the law, a lot of 485 applications will be pending for 6-8 years or more. And for the duration of this period, a lot of people will invoke AC-21. I also think that the rate for rejection for number of AC-21 cases at USCIS will be higher. Nobody told me about the approximate wait time and rejection rate. It is just what I think based upon the developing situation.

Please post all your details such as how long you were with your old employer,
when did u inform uscis about your new employer.
Was there much difference in ur salary?
Is your GC approved? Which stage are u in.
