Immigration Voice is proud to announce the launch of Team IV, the walking/running club of Immigration Voice.

Yes, that is what the trend look like. There is probably another 5-10% fall in the works. Perhaps even more. I agree with you on that.
However, the million dollar question is how do you know the prices have actually bottomed one? Won't you go ahead and buy if its affordable, instead of wasting precious years which shorten the career span and deferring your decision? Its almost like deciding when to have your first child...well..almost. There is never really a good time, is there?
By affordable, I mean its around 'x' times your (dual) income, you have your green card and you are prepared to live in the US for next 5 years at least (even if there is any family emergency, you don't have any compulsion to sell off your assets and move to India for good). Now, 'x' may mean different for different people but generally people seem to agree x = 3. And I also agree with you that it might happen that american housing is always affordable. Yes, it might but for most middle class in SFO Bay area, when x was 7-10, it wasn't affordable at all!
I completely oppose folks like Slumdog doing something terribly rash (no gc, no prospect of gc within a year, single income with a baby, baby having some health issues and to top it all the burden of a heavy mortgage on the shoulders, god, I think his situation is simply awful...) but the way I read it is that these indeterminate immigration waits are making people throw caution to the winds.
And I don't agree with folks who feel that buying your house is like renting it out simply because it is mortgaged. There is big difference, eventually its get all paid off and you start actually owning it. Secondly, for a lot of people that they can sell it during their retirement and use the sale proceeds to cover the retirement life. There is very good chance real estate would have appreciated over long term. Of course, you are just interested in 'flipping' you are asking for big trouble.
If you think renting is not 'quality of life' and you see it is affordable and prepared to lose money go ahead and buy. On the other hand, if you don't mind renting and don't feel like losing your hard earned money wait for the downturn to be over.
The rate of fall is so much that it is better to lose on the rent than buy and lose over the next years depreciation.

Thanks for this useful info. My attorney filed 485 concurrently with 140 last month. The USCIS physician did Skin test instead of X-ray. Do you think I will get an RFE for this?

I agree too. Visa Re-capture is the only solution which is available at this time. Now we have actual data in hand. We need to build a strong case, for ex person with priority date of 2004 have x number of people ahead of him, based on the numbers available per year for EB3 (I) It will easily take more than 5 years, That means total time for GC process from start to finish is >10 years.
One has to work in similar position for 10 years.
We can brain storm points like this an d build a strong case for admin fix/ Visa re-capture...

There are some members like bitzbytz who have already filed their I-485 in 2007 and their priority date is right around the corner. They've only got a couple of months to go.
But then there are the rest of us who have a much longer wait. My brother, for instance, is looking at 5 or 6 years to get his green card. I got put through a Technology Alert List (TAL) check last time I went to apply for my visa, got stuck for close to 3 months, and will likely have to go through screening every single time I apply for a visa. Needless to say, it is a major pain.
I am sure there are more members like me who are going through similar issues or who have to wait years for a green card. If we don't lobby for changes, who is going to do it for us? It's going to be very difficult to get anything done with the mentality that 'I will participate / contribute if I see results'. ' It's highly unlikely that it is going to be successful, so what's the point?' Now, I'm not naive or stupid. I know that reducing the EB backlog is a very difficult task. However, if we don't start doing something about it, it's going to stay like this forever or get even worse. It's not going to randomly change out of the blue.
If you are happy with the status quo, that's fine. Like for example, if your green card is right around the corner like bitzbtyz, or you really don't mind whether you get a gc or not like designserve, that's fine. However, if it's important to you like it is to me, then we have to DO SOMETHING. No one is going to do it for us. We are it. By all means, don't participate / contribute to IV if it doesn't serve your purpose. However, if it does serve your purpose, or if you have family or dear friends that could benefit from EB backlog reduction, then I am requesting you to help by participating in Advocacy days and/or contributing.

Remember Lame duck session. Now imagine having twice as many members, double the number of phone calls and faxes and emails. Double the activity and contributions.
We do have to make sure that next time (read: Jan 2007) We go with a bigger organisation. What is the use of talking strategy or doing things with the same number of people.

easy dude..this poll was just to see how many people in IV from 2002 PD for eb3 India. Its just for that purpose and nothing else. I know EB3 is a dead meat for India..I am with you on that..But dont beat your life for it..relax.
Honestly I don't even see a point for these discussions, polls or predictions for EB3-I. The sooner we accept we are doomed the better. The only way out is to help ourselves but I don't think many EB3's are willing to do that.
I spoke to several in my office with earlier EB3 PD's (who might not even get GC's in the next 5-10 years !) and of course with EAD's and they have literally substituted EAD for a GC. They were once a part of IV (and some similar org's ?!) but now have completely lost hope and don't care. I tried to motivate them to join IV and support but they feel that IV does not cater to EB3's anymore. Sadly they are not even trying to port to EB2. They are just content with a job and EAD.
So, I am not really sure how many of us are actually willing to fight ?!
In fact it's even worse for people like me who are still waiting to file their I-485. Is it going to take us 5,10 or 20 years just to get an EAD ?!

My daugther's date of birth is 03/18/1988. We filed I-485 together in 02,June 2007. We all recieved I-140 approval and I-485 receipt.
I would like to know whether my daughter will age out in 03/18/2009 or 03/18/2010?. She is working as RN ( 2 year degree) in hospital under EAD.
Please send your advice preventing from age out issue.

You can just take the 5-10 lines from the report which shows wasted visa numbers from the past years and send it to all lawmakers from all states asking for visa number recapture legislation
I think its just one small paragraph the lawmakers have to insert - They can attach it to any major upcoming bill - This does not create additional numbers or change the existing laws in a big way.
it is not that simple..... lawmakers have been told multiple times of the long waits in eb3..... this information in the report by uscis ombudsman is not a new revelation...... this may be new to some in our group but the guys in congress know it all along.....

Anything with the legislative effort aka unused visa recapture will not happen in this political environment.
My only question to the EB3I is,
Do you want to wait until the visa recapture, when ever it happens or will it ever?. More-over this has been taken up by many people in this forum and fizzled. To add more, do you know what will happen when un-used visas are recaptured ? Will it benefit EB3I or will it be given to EB2 just like the spill over. Would you do something right now to atleast get some short term relief to EB3I ?
I am here in this thread to understand what we can do for EB3I immediately. I presented an option when somebody asked in this thread. If you want to take it or leave it, its up to you to decide.

Rather it would be in their interest to cross port to EB2 since they directly become current rather than wait for spill over to reach their PD which is good 3-4 years away. So my argument is there are three interest groups here

2) Eb3 prior to 2004
3) Eb3 2004 onwards.

Sometime back some other person on the forum wanted USCIS to give GCs if candidate buys a home - what a foolish idea. He thought it would help the economy. How? Buy if you can't afford and then go into foreclosure?
Rest of the points are fine except I don't think involving social security is this is going to fly! Too sensitive a topic.

There are too many assumptions here. How I see this situation is;
EB3 I will not move significantly unless and until oversubscribed EB2s become current. Even then, it cannot be taken as granted because the demand of EB2s can take all the spill over and be current without spilling to EB3. USCIS will eventually make the change once they see that EB3 has significant retrogression and there is a lot of noise made about it.
The solution I see is; we can make a valid presentation showing the effects of this spillover change in the long run and how EB3s will be affected seriously.
If DOS continues with this interpretation of spillover then there is a very small (tiny) window coming up in third quarter of FY 2010 (Apr'2010) where we might see some spillover to EB3. Here is how:
Currently there are total 4050 (EB1) + 74932 (EB2) = 78982. These are mostly pre-adjudicated and waiting for VISA numbers.
Total allocation for new FY is 140K out of which 40K (28.6%) will go to EB3. So EB1 and EB2 will have 100K left but their total demand is only 78982. So these 21K numbers will be left which will be used for new applications recieved under EB2 category.
When PD for EB2-I/C moves forward, there will be more applications coming in because many EB2-I/C people have their labor approved and they are waiting to file their I-485. However, when these new applications comes in, they are NOT processed yet and their background check is not clear yet. So even if visa numbers are available for them, they are not ready to be approved.
So at this time we poor EB3 people can hope some mercy from DOS and we hope that DOS might spill those remaining 21K numbers to EB3 so we don't waste any numbers while USCIS is adjudicating those newly recd applications under EB2.

EB3 I will not move significantly unless and until oversubscribed EB2s become current. Even then, it cannot be taken as granted because the demand of EB2s can take all the spill over and be current without spilling to EB3. USCIS will eventually make the change once they see that EB3 has significant retrogression and there is a lot of noise made about it.
The solution I see is; we can make a valid presentation showing the effects of this spillover change in the long run and how EB3s will be affected seriously.
If DOS continues with this interpretation of spillover then there is a very small (tiny) window coming up in third quarter of FY 2010 (Apr'2010) where we might see some spillover to EB3. Here is how:
Currently there are total 4050 (EB1) + 74932 (EB2) = 78982. These are mostly pre-adjudicated and waiting for VISA numbers.
Total allocation for new FY is 140K out of which 40K (28.6%) will go to EB3. So EB1 and EB2 will have 100K left but their total demand is only 78982. So these 21K numbers will be left which will be used for new applications recieved under EB2 category.
When PD for EB2-I/C moves forward, there will be more applications coming in because many EB2-I/C people have their labor approved and they are waiting to file their I-485. However, when these new applications comes in, they are NOT processed yet and their background check is not clear yet. So even if visa numbers are available for them, they are not ready to be approved.
So at this time we poor EB3 people can hope some mercy from DOS and we hope that DOS might spill those remaining 21K numbers to EB3 so we don't waste any numbers while USCIS is adjudicating those newly recd applications under EB2.

ok i managed to find it...but its not easy to find...the average person visiting this site will never know about it. This is a cool benefit...it should be advertised on the site more so people can take advantage. It will certainly generate more interest in IV

Since we now know that SA 187 had nothing to do with immigration and that it WAS indeed passed, the possible typo in this thread (about SA 187) title should be changed to something along the lines "Senate immigration amendment to H.R 2 NOT passed".
Besides we should whoheartedly explore with Kennedy, Kerry et al. if they game for pushing the immigration amendment (w/o the hard 10% country cap) in the house-senate conference.
If they are playing politics with the Sen Session illegal immigrant amendment (which passed!) we might as well use their tete-a-tete to our advantage ;)
BTW sen Sessions amendment also did not pass. It was just introduced, Th estatus of SA143(session's amendment) and SA180 is same.
