    There is something called fraud protection fee that companies pay for initial H1's. So USCIS has the funds to protect the fraud, the question lies if they are really implementing it.

    The GOVT should state that those who apply for H1 should make it mandatory for the employees to be in US within 30 - 45 days of obtaining US Visas and be present in US on employment in continous increments of 1 year. And they need to show pay stubs continously.

    - Then we can easily filter out WIPRO, Infosys, Consulting company from misusing. For example Wipro will apply 5000 H1s and then send people when they eventually get a project, out of 5000, may be 1000 may show up in 6 months. So In this case 4000 H1s can get invalid. Indian companies find it sending people overseas is expensive business and would enjoy offshoring projects. If the govt makes this rule, consulting companues will be forced to start paying H1 folks from Day 1, no bench period, plus "Candidates need to show up in person immdlty in US". We kill 2 birds with 1 stone. 1, dummy H1s will not be applied, 2, if they approve H1s then they have to send engineers immdlty for which they may not be really ready, since they only anticipate projects and may not need so many H1s right away !...

    THis will be a sure shot solution.

    It is very clear that USCIS is yet to complete the receipt of all I-485 applications and are not in a position to give any statistics to DOL. I think then they will be busy in issuing AP / EAD based on the receipt. Considering the current work load, I think it will take at least couple of months for the USCIS to give any reasonable estimate to DOL regarding the actual demand. Till that time, I think DOL will be forced to publish the same status every month. :(

    I wish USCIS can use the people worked in Backlog Elimination centers to issue EAD / AP and clear I-485 receipts and provide some meaningful figures to DOL. [I hope they do not create another July bulletin fiasco :D]

    One small correction,it is DOS instead of DOL.

    My wife attended the rally yesterday and this is what she wrote her friends who didn't come to the rally!

    Yesterday, Shyam, Isha and I spent all day in DC as part of immigrationvoice, a grassroots non-profit organization that acts as an interface between highly skilled immigrants and the legislative and executive branches of the government. It was a wonderful experience. Over thousand people met at the foot of the Washington monument, and walked all the way to the US capitol. The organization had made good arrangements. Its amazing how people from all over the country were there and very few local people. One South African couple had driven on Monday from Indiana and came to the rally to celebrate the husband's birthday!! He wanted to be a part of this rally as a present for his birthday. We had 2 people - Manish and Sri, from New Hampshire staying with us on Monday who came just for the rally. There were some british, some chinese along with we Desis.

    The need for the rally brought to light the real issues -

    Most of us may have applied for our I-485 Step 3 in the greencard process, in July 2007, but that doesn't mean we will get our green cards soon. The govt accepts only 140000 applications a year and only 9000 are allocated to Indians in all categories.

    Lawmakers and congress are confused when they think of immigrants - they club legal and illegal together. Even the Seattle senator who addressed the gathering yesterday made the same mistake. He said its good that you guys are out here so the congress can see its not only the janitors and others who have immigration issues but also highly skilled immigrants! No mention of legal. He used his time to promote the democratic party and we tried to remind him we don't have voting rights even though we pay the same taxes and work like everyone else!

    We have to do something to be heard and heard right!

    Thats the beauty of this country you can reach out to people in the highest positions and get heard. When the voice is collective its even more powerful. Shyam along with many others met with many congressmen and senators over the span on 2 days to explain our plight to them. One congresswoman mentioned that when a bill comes to vote in congress she polls the number of phone calls and emails she gets from her constituency and submits her votes accordingly. I was surprised to see how much actually our voice means.

    We don't realize the power we possess since we are sitting in our own life bubbles of work, home, stress, kids and everything that most often swallows our individuality and ability to think. We need to step up think for ourselves and and help ourselves and everyone else in the process.

    Like Sheela murthy, one of the leading immigration lawyers, said that yesterday's rally and the forum immigrationvoice.org (https://mail.medimmune.com/exchweb/bin/redir.asp?URL=http://immigrationvoice.org/) may not make an immediate impact. But we are truly paving the way for the future of legal immigrants to the US.


    The forum is the only organized and collective way to get out our frustration against the system! So many people don't understand the hardships and seriousness of the greencard issues. Especially the people who got their greencards pre 2001 era!     I will be taking my child to India for the first time. She has a US passport, both parents are from India - I am not sure if I should just take the 10 yr visa for her or apply for the overseas citizenship card. Is there a benefit to use one over the other? How long does it take to process each of them? Please help. Thanks.

    Hope GC will come by that time ...

    No approval so far .
    I am starting to get worried as my current EAD expires on sep 17 and also heard that the second email of card production ordered is taking arnd 1 month from the day, EAD approval mail is sent out.

    No matter its 1 yr or 2 yr , I want my EAD approval in time.
    :P

    Mine expires september 24th and very much worried.
    As you said, i also dont care about 1 year or 2 year, till the time i can keep on working.

    Let me know if you planning to do something.

    Who will help us? How to proceed? When to Start?

    No answers.

    No one will help EB3.

    God only will help.

    Help IV...by doing like in Action Items of IV, donating some if I/you/we can.

    I know many of my EB3 friends thinking of apply in EB2. For that they are seriously considering other job offers. Probably they may get porting or not but they will be in good shape soon.

    Soon, I guess, there will be many EB2 filings (in 2010) if EB2 I progress like this. If 25% of EB3 people switch, there will be some good for rest...

    There will be some help from Congress.......not pretty soon, but after this recession if we constantly in touch with them.

    Never loose hope....as you said, God looks all of us.

    I am reading this article for a while and wondering what heck is going on. There is not a question of buying vs renting . This has nothing to do with the quality of life .

    We all know every one would love to own a house. But everyone can not dare to become owner in this country.

    1) Home prices are still unreachable
    2) H1B/EAD/485 - No surity of Duration in USA
    3) Not enough money to buy ,alternative is to rent (we have to get shelter somewhere)
    4) Job location is not fixed

    Buying is not easy for everyone. When we buy some item which we can afford to lose then buying is very easy . Like we buy Iphone etc after too much reasearch but the price is so little , we always forget about this purchase after week time. Even we broke or loose iphone we do not care after few months.


    If we have enough money we can buy ---Buying/shopping is a fun if we have money .
    If I will have extra few money , I will go have a dinner with Aishwarya ,that is also a Fun ,
    but going for dining at cheap restaurant as well ,knowing that you do not have money to repay is not a fun.
    But buying/shopping with debt is not a fun we have to plan very carefully.


    As said it is fun ,It is individual choice to buy or rent . All depends upon circumstances.
    If your circumstances are favourable owning a home is a fun and I am sure every one wants to have some kind of fixed address to go.

    GC or no GC - Irrelevant question.

    Buying is habbit. It is good and very funny if you have lot of money . It is very Bad if you do not have enough. At somepoint you have to stop buying (in other words no one lend you).

    So guys enjoy life .If you can afford buy house even buy million bug dog no question asked . Plan carefully when you have to buy by means of Loan. If yoy think you are in better position to repay go for buying necessary part of life like house. If you 100% sure that million bug doggy is not going to put any whole in you pocket ,go for it guys....

    Every time someone comes up with something new they get shot down here by "certain" other members. They try to find reasons to say it was a bad idea rather than saying something constructive. Give this guy a chance.

    Fair enough...I'll wait to see what "constructive" ideas you have to offer regarding this topic. I have seen this beaten to death with discussions and polls and countless posts on analysis, but absolutely ZERO talk of advocacy and/or steps for getting anything in action. If you were to give people something worthwhile to act on or even something that shows your commitment to the cause, I would have no issue.

    It might have been answered before elsewhere, but I'm wondering about the logic on how the spillover visas are allocated. Would have been nice if the spillover visas are allocated to oversubscribed countries instead of categories, this way 10k spillover visas that EB2-I is getting now will be distributed equally between EB2 and EB3 ... I believe that's one thing IV is going to or has taken up.

    Looks like parents did a good job of taking both the sick kids to hospital, but the doctor treated only one kid saying that the second untreated kid is not good as the one getting the treatment :D ... if the 2nd kid survives thru the period of time the 1st kid recovers without any treatment, then the 2nd kid will get the treatment.

    LOL, why am I extending the topic ...

    I for one would like to know exactly what IV is planning to take up for the cause of EB3 before contributing.

    Good and very valid logic....
    I am also EB3 (waiting for 6 years now) but I totally disagree that IV is baised against EB3 or favoured EB2 in anyway, we are not heard as fault is ours. We we want something for us to be done then our actions shold speak for all of us just not me or you). Either we put up a fight for our cause (there are chances we will loose) or just submit to our doomed fate. The choice is ours gentleman. I don't think we have tried enough to finally call it quits.

    With this attitude and arrogance, I rarely think there would be motivation for anyone to do anything for IV.

    I started discussion by asking , how can IV convince me that my donation is going to help, I got shot down by ARROGANT ******** and got all reds as if I care. I was planning on a charity/donation drive of my own to get some money for IV.
    Know lot of consultants, who really dont know what to do with their miles with every one a executive airline status.
    Already have 10+ people pledging Poker tournament from my poker group with their miles for Airlines and hotels. We are talking of a Million AA miles.
    Indian restaurants(s) having a Immigration week where a dollar of each bill be given to IV.
    I was even thinking of standing at Indian stores in Dallas to ask people to consider for IV cause, as long as I believed and hence was asking.

    I was just getting started with so many ideas for my free time.

    Good luck in what ever you do guys. Note that GC is not everything and note that I am still on extended H1, family on H1 and EAD never helped me. so assumption that EAD helped my life is baseless. All these hypocrites are long gone from IV once they get GC. All we get is response that Mr X or Y , even after getting GC, is working fro cause. How can I believe.

    Any organization can be successful if there are questions answered and not shot down. Just working at DC doesnt make some one a strong contributor for IV.Work at grass root level is so imp. What I have noticed is any one who went to DC has become headstrong, egoist and arrogant as if they own IV.

    If you wanted to do anything you would have done something since June 2007 when you became a member. What did you do since then?

    Now your PD is getting current and you are close to Greencard. You WILL NOT do anything. But you will become an anti-immigrant for sure as someone wrote on the forum. As I understand, nobody is here to convince anyone else. Everyone is dong it because they want to do it for their application and they are doing the right thing. IV is a non profit. Each person is supporting because they feel they need to help themselves by helping IV.

    I received an audit as well. DOL needs docs as below. How long does audit cases take to process? Seems like my attorney missed some docs or is it common audit as he said it is a random audit?

    1. The documentation listed on the following attachment supporting the
    attestations made on the application
    2. A copy of the submitted ETA form 9089 with original signatures in Section L(Alien declaration), Section M(declaration of preparer(if applicable)) and Section N(employer declaration)
    3. Proof of business necessity as outlined by 656.17(h) if the answer for question H-12 is no, the answer for questions H-13, H-15 or H-17 are yes, or the job duties and/or requirements are beyond those defined for the job by the SOC/O* Net code and Occupation Title provided by the state work force agency.

    4. Documentation required for live-in household domestic service workers as outlined by 656.19(b) if the answer to the question H-18 is yes

    5. Notice of filing documentation as outlined in 656.10(d)

    6. Recruitment documentation


    Any suggestions?
