I am looking for advice on the strategy for filing the third phase since the PDs for my wife and me have become current. My PD is Feb 2003 (EB2) and my wife's is June 2003 (EB3). My wife and I are on 8-th yr H-1B extensions with approved I-140s. Which strategy makes sense and are they even valid? The objective is to go with a risk-free strategy that gets us the GC in the quickest manner.
1. I apply for I-485 (AOS) using my PD, with my wife as dependent. And my wife applies for I-485 (AOS) using her PD, with me as dependent.
2. I apply for I-485 (AOS) using my PD, with my wife as dependent. And my wife applies for Consular Processing using her PD, with me as dependent. OR vice versa.
3. Any other option?

We EB3 folks are not requesting for EB2 visas. We all will be happy to get 50% EB1 spill over visas. The other 50% can go to Eb2s.
right now 100% of EB1 spill over is going to EB2.
Allocation of immigrant visas is not a policy matter. It is based on law. Any change should come thro law change. Congress (&president) has to amend the law (INA) how to modify the allocation. It is not a simple matter. Both DOS and USCIS knows it unfair to keep EB3-IN in 2001; but they can't do any thing. Thats whu EB3-IN folks should try hard to make the congress to change the law. Contacting DOS or USCIS not going to help, as they have no authoity in changing the allocation methods (they only execute the methods).

It is so sad that H1Bs are exploited by those "consulting" companies (which essentially are "human trafficing companies" like doing "slave trade") while Americans (at least some Americans) hate H1Bs. We are like modern "slaves" that nobody cares about. :rolleyes:

I started working from February and have paystubs till July.
Planning to go India in August and get stamped for H1 in chennai consulate.
My husband has to renew his H1.
My questions are
1.)If incase my H1 gets rejected, I am planning to come on H4. Do i need to pay the fee again in HDFC for H4 and book an appointment or I can just walk-in some other day for H4 stamping with my husbands valid H1-B petition and other other required documents.
2.)We both are working for different employers. Can we take H1-B interview together?

Getting into the spirit of the class, he asked students which presidents had sons follow them into the White House, then answered in Spanish.
He and his father, Bush said, and John Adams and his son, "Juan Q." Adams.

IV had brought in hundreds of T - shirts to hand out. We were giving them out to everyone with a request to contribute on the web site. When we were out,
one of our volunteers, Kaushal, I think (don't know iv handle), he took out his own IV tshirt and gave it away!!
Another thing, I want to thank all the volunteer(s) who were asked to stay back to take care of the origin point and couldn't march in the rally.

After doing a conference call this weekend, we think we should close this thread. There are not enough people for us to consider a large public campaign. However this does not mean IV is not and will not be working on this fix. This fix has been a very important fix for IV for several years and we have it in our legislative and admin fixes agenda. Those that came for the recent advocacy day event know that it is a key provision that relates to our quality of life concern. Every other legislative fix we are trying is also tied to I485 filing. We advocated for this fix in our just concluded advocacy days and will continue to do so in every opportunity we get. The purpose of this thread was misunderstood and people thought IV will only work on this fix if there are 5000 votes.
We were at the time of starting this thread considering a possibility of launching a campaign like http://immigrationvoice.org/forum/forum16-iv-agenda-and-legislative-updates/17157-deadline-march-1st-target-25000-letters-can-we-make-it-happen.html when the timing was right.

For a campaign like that to succeed the number has to be way higher than what we achieved in 2008. Again just writing letters will not do anything. You need a big organization like IV behind it where we take all these letters with us for the meeting. We also need a strong ongoing advocacy effort in DC though lobbying.
Another point to be noted for all people wanting to file I485 is not to think narrowly about your own I485 application. It will be counter productive to your own cause and the overall effort we are trying to do. This also applies to people who have filed I485 and do not wish others to be able to file I485 because their own application might be delayed or some other reasons ( Here is one past example . Many posts on this thread and many such divisive threads are deleted because they were too offensive but you will get an idea http://immigrationvoice.org/forum/forum14-members-forum/2714-why-are-we-suddenly-obsessed-with-uscis-efficiency.html ) . We are going to adopt a zero tolerance policy to such people when we come across. People who think narrowly about their own I485 application and fail to understand the full picture of the EB backlog should not be part of this effort. It is better to not respond to such people and lose such people from this effort rather than trying to be all inclusive. We cannot waste our time to either keep such people happy or fight with them. If there are any such narrow minded people for or against this fix, they are free to cancel their recurring contributions and find their own ways to get their I485 fix done or oppose IV's I485 fix effort.
For people who have voted and want to work on this fix, please contact the leaders of this initiative ashwin_27 and starsun. There is a google group where most active members share their views. The entry to the google group is restricted and the leaders will have to speak to each interested person before permitting access. There will also be public action items posted in the coming weeks for everyone that has voted. These action items will also help you to raise awareness of this issue. We are closing this poll at this time so that there is no misunderstanding and people who have voted understand that there is more to getting this fix done than just voting and going away or complaining that nothing is happening.

Did you take infopass. I had taken on 26th and officer told me mine was at last (6th) stage of processing and waiting for one of the multiple background checks done. Everything else except these results is cleared.
Did you contact your Congressman/woman. I did in-parallel to infopass to see what I can learn from them as well as cross check info-pass BS.
Eat out & drink beer. Last night I had Hienken and cursed everything/ everbody. Today morning I am Green!
Try above suggestions except the last one.

Also one unusual acitivity of USCIS has been to suspend premium processing of I-140 for the month of July. That to me suggests that they are preparing for the deluge of I-485s.

You will be notified by mail when a decision is made, or if the office needs something from you. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or call our customer service center at 1-800-375-5283.
Me and my wife were called for interview at Newark, NJ office after we got the Notice for case transfer in Oct. 2009.
I think the notices we received at home did mention the Newark, NJ office, don't remember for sure.
I have an INFOPASS appointment this friday, 27th May to find out why is it taking time for my case to be approved.
Hopefully, there will be no problem with my case.

I e-filed my EAD and send documents.

I got my US Masters degree in Engineering in 2002 and I was obviously concerned that I would be left out if this is limited to people getting degrees in last 5 years. I read the text and here is the crucial part for people like me:
"(ii)(I) obtained such degree within the United States during the 5-year period preceding the date on which the petition filed under section 204(a)(1)(F) for classification under this subparagraph is filed; or
(II) has resided continuously in the United States in a lawful nonimmigrant status since obtaining such degree; and"
"(ii)(I) obtained such degree within the United States during the 5-year period preceding the date on which the petition filed under section 204(a)(1)(F) for classification under this subparagraph is filed; or
