I rode the nc bus to dc (ok raised funds, booked the bus, cajoled/threatened people/got permissions/negotiated deals blah blah...in partnership with ramus and gc_prasad). We started at 2 am from RTP and were in fairfax by 7:00. there were 38 people on the bus including a 2 year old. :) IV had arranged for a halt at a gurudwara in fairfax - we spent about 45 minutes there cleaning up and drinking tea. The bus dropped us off at Franconia/Springfield metro at 8:15...we took a while figuring out those metro farecard vending machines. Some of them wouldn't give us change...some others wouldn't take credit cards. But we survived. In 10 minutes, 38 people had farecards and were raring to go. We got to the monument at half past 9...and folks were already lining up, holding placards. I only had time time to meet my company brethren from Cal and then paskal. I dropped off a stack of petitions with ashish (hopefully they made it to IVs pile). The nc contingent walked together most of the way to the capitol...it was a truly great feeling, having people honk, wave and generally be nice. I could never have imagined myself out on the street, fighting against broken systems...in front of the US Capitol. But yah, it happened. During the speeches, i walked around the audience, asking folks to turn their placards to face their cameras...(something to learn for next time - thats why political events have twin sided placards - so that cameras facing the speaker get the message). After the rally, i got to one lawmaker meeting with????'s staff. They were pretty cool to talk to...while they may be aware of some broad issue with legal immigration, they seemed to fall into the "oh you are talking about h1b quota" trap. We set the framework for discussion early on and clarified the "we are talking about gcs here" point.
Some of my nc colleagues went on to meet ???? - they had a productive meeting there too...perhaps Rahul will write about it. After the meetings we made our way back to the franconia metro, had dinner at the springfield mall food court and left there by 8 pm. We were back in RTP by midnight. In all 22 hours...well spent!

one of the things I did today was send out a note to all my friends groups...while most people seemed to ignore all pleas to join the rally or contribute $, they all seemed to be watching curiously. A lot of them feared going to the rally...some others didnt care. Some others even promised to show up and didn't. But i believe we need the support of these very people, if IV has to grow and become an even stronger force in the future...I shall copy paste wot i wrote, and i encourage all to write to their skeptic friends...only to point to a positive experience and ask for their future participation. So i quote...
"Some might wonder why we participated? Well, how could we give up on a chance to make history and truly understand what it means to live in a democracy. Its not about desperation for a green card, its about fairness and dignity. We believe that we have the right to a fair, open and predictable process and anything else is an affront to our dignity. We believe that the system is broken and can be changed. But change to the system will not come overnight and it will definitely not come with us keeping quiet. So we got out and did what we knew was possible - get the message out, propose solutions, meet congressmen and appeal to people's conscience.
In participating in this movement for change, we realized something else that we would like to share. We realize that the struggle for a fair immigration process is but a process of change just like struggles against oppresion and prejudice of different severities. The only difference is that its a question of dignity and fair process versus segregated facilities and disenfranchisement. Accept one and you accept the other. So if we wonder how the world could have every been a certain way in the past, we don't have to look beyond ourselves. Honest and well intentioned as we might be, if we cannot stand up and say something about something that affects our rights and freedoms as individuals, we are saying that we are OK with all that is around us.

Thanks for making me look like an idiot in front of my lawyer and HR, everyone.
Based on RUMORs that "USCIS may get allergic reaction to too many 485 files, and stop accepting them in mid-July" I asked my lawyer this question:
I have a question about July Visa bulletin. If the August bulletin is retrogressed when announced in mid-July, can the USCIS change rules and stop accepting new Adjustment of status petitions in mid-July ? I know that it sounds illogical and that July bulletin's current dates would apply thru July 31st but I am hearing from my professional colleagues that USCIS could change rules and stop accepting new AOS petitions in middle of the month.
And I got this reply :
Yes, what you raise is quite illogical. The visa bulletin controls which AOS can be filed during the calendar month for which it is published, there is no way for USCIS to stop receiving an AOS application received say on July 16th. AOS is not like an H1B filing, where there is a finite # that must be received by a date certain and then allocated.
See, hear that ? "NO WAY FOR USCIS". Now, I dont know why some lawyers are spreading this nonsense that "BEWARE, USCIS will stop accepting new petitions if they receive 'too many petitions'. What is 'too many ??? Who defines 'too many'? Is 'too many' defined as the time when the mail room clerk gets back pain from lifting boxes of petitions ? Or the guy printing 485 receipt notices gets carpel tunnel syndrome ?
PLEASE PUT THIS IDEA TO REST. USCIS WILL ACCEPT PETITIONS THRU JULY 31, NO MATTER HOW TIRED THEY ARE AND NO MATTER HOW SICK THEY GET OF SEEING 485 FEDEXes COMING IN DAY AFTER DAY AFTER DAY. GOT IT ????

I can't tell you how p***d I was when I read someone suggesting ppl to "enjoy the moment". For someone who has been waiting 3-4 years for labor to clear and sees ppl getting in front of the line to get the EAD/AP, its just insane. And to tell that person to be not a "spoilsport" is just rubbing salt in their wounds!
To my friends who are still stuck in PBEC, please have faith. You will hopefully be able to file 485 even after Sept when the dates retrogress again. My gut feeling is that dates will retrogress back to 2004 again. 2005 is when PERM started and that's where the bulk of applicants will come from right now. PERM filers will get the advantage of AC21 that you didn't have for all these years but plight of ppl stuck in BEC's has never been on anyone's agenda. So not much you can do.
In this process everyone gets screwed onetime or other . Everyone knows that dates will move back but the advantage of filing now is the applications enter into preprocessing stage after 10 months or whatever.

Congratulations on clearing your first hurdle. I talked to my attorney today and she said that audit reply was on March 11th, and need to wait 4 months before we can contact the DOL about the follow-up. Need to wait 2 more months.

As per pending list of Emploment based I485 published by USCIS , and per my my estimation, EB3 with PD up to Dec 2004 will be cleared on or before Sep 2010.
Further if EB4 , EB5 , and EB6 spill over is allowed , then up to PD Sep 2005 (EB3 ) will be cleared by end of Sep 2010.
I wish this was true, good to see your optimism. I am not trying to shoot you down, but all the numbers published and crunching says otherwise.
Do you have any formula/facts that you could share with us? Or is it just your hunch/intuitions?
Our only hope is recapture. We all need to unite and work towards one common goal.

I just called them now. I was lucky enough to talk to the operator. She said I should be getting it in a week. I guess they have a back log. She couldn't tell me anything else. BTW my application was received on Sep 11th. Money order was cashed on Sep 23rd. Still in process not shipped yet. I called 713-626-2148 and pressed 1 then 9 and when it asked for voice mail or operator I pressed 0 for operator. I kept pressing 0 until someone answered.

It is indeed unfair to the people whose applications are struck in BEC forever. The people who are still stuck in BEC are the very first ones to enter the queue. The BECS are now processing oldest cases now.
My guess is dates are going to move back by september any way and the probability of one getting GC who files in next month before the dates move back is very low.
Most of us here have to get ready for 5 or 6 years on EAD any way.

Actually today I received my CPO e-mail, so I will go down through my list! But anyway,
1. You can contact your local congressman and explain your situation
2. You can visit your local USCIS office through an Infopass appointment
3. You can file an ombudsman form (google it)

I am from Chinese community and registered IV just a couple of week ago. There was no email message to me regarding this movement, and some other registerd users may encounter the same situation. You may need to resend them. Only when I opened IV website yesterday did I know this recurring program and current situation. I am assuming IV is the only group who are pushing to get the I-485 relief for high skilled workers with advanced degree. There are MANY MANY Chinese in the same situation but I guess there might not have so many Chinese in IV. IV core group may think of some better way to reach more Chinese or other communities. Basically, we are on the same boat for the same direction. Better to concentrate all resources to reach the same goal. I would suggest IV to setup a seperate Chinese (or Hispanic) contribution page to diverse the culture background of IV members.

For filing I 485 I know you need to submit birth certificate and marriage certificate. Do both of these have to be originals or copies are fine ?

copies are fine; in fact, you must NEVER send originals. They will not return them. you should keep originals with yourself in case they ask for them during interview (if interview is needed).
